Terms of Service

1. Who we are

Fellystar Studios makes custom 3D Roblox and Minecraft animations. The service is run by:

In these terms, "we" and "us" mean the seller above, and "you" means the person who uses the website or places an order.

2. What these terms cover

These terms apply to:

• the website fellystar.net and its order page (the "Website");
• the free electronic services on it: your account (sign-in with an email code), saved characters, the order form and the contact form;
• every order for custom animations ("Videos") placed through the Website.

You can read, save and print these terms free of charge at any time on this page. The version you accept when ordering is also sent to you by email.

3. Who can order

You must be at least 18 years old, or a parent or legal guardian placing the order for a child. By ordering you confirm this.

If you order for your company, some consumer rules below may not apply to you. Sole traders ordering for their business, when the order is not part of their professional activity, keep the consumer rights described in sections 11 and 12 (Article 385⁵ of the Polish Civil Code).

4. Using the Website

To use the Website you need an up-to-date web browser with JavaScript turned on and an email address. Paying needs a PayPal account or a payment card accepted by PayPal.

You may not use the Website to send unlawful content, to attack or overload it, or to impersonate someone else.

Your account is free. You can stop using it at any time and ask us to delete it by writing to fellystar@outlook.com. We may close an account that breaks these terms, after telling you why.

5. Placing an order

1. Add your characters, choose your videos (length, extras, reference link, your idea) and check the price summary.
2. Sign in with your email.
3. Tick the two boxes to accept these terms and to ask us to start work straight away (see section 11).
4. Pay with PayPal.

The contract is made when your payment is completed. We then show your order code and send a confirmation email with the details of your order and these terms.

We may refuse an order within 2 business days, for example if it asks for prohibited content (section 8) or if we cannot make it. You then get a full refund.

6. Prices and payment

Prices are shown in the currency on the order page (USD) and are the final price for the order. Final price. No VAT is added.

Discounts (bundle, first-order and referral codes) are shown in the summary before you pay. Only one of the first-order discount or a code applies: whichever saves you more.

You pay the full price in advance through PayPal. PayPal may convert the amount into your currency under its own terms.

7. Making and delivering your Videos

• Single-video orders are delivered within 7 days of payment. With the Rush delivery extra, within 48 hours.
• Orders with 2 or more videos: we email you a delivery schedule within 2 business days. If it doesn't suit you, you can cancel for a full refund before we start work.
• We may send you a storyboard or a preview while we work. Tell us if something is wrong at that stage, when changes are easiest.
• We deliver the finished Video as a digital file (usually MP4, vertical 9:16 unless agreed otherwise) by a download link sent to your email, or on Discord if you prefer.
• We need your materials and answers in time. If we are waiting for you, the delivery time pauses until we have what we asked for.

8. Your materials and prohibited content

You may send us characters, skins, usernames, reference videos, music, voice recordings and ideas ("Your Materials"). You confirm that you have the right to let us use them to make your Video, and you give us permission to use them only for that purpose.

We will not make Videos that:

• are unlawful, or break someone else's copyright, trademark or other rights;
• contain sexual content, or show minors in any sexual or harmful way;
• promote hate, violence, terrorism or harassment;
• show real, identifiable people without their consent, or are meant to deceive or defame;
• are meant for scams, phishing or other fraud.

We may refuse or stop such an order and refund you for any part of the work not yet done.

9. Revisions

• Free: fixing anything that doesn't match your order or is our mistake, and small tweaks (for example timing, text, small camera or colour changes). Ask within 14 days of delivery.
• Paid extra: changing the core of the Video after you approved the storyboard or preview (new idea, script, characters or scenes), trying several versions to "see what works", and new requests. We quote the price first and do nothing paid without your agreement.

This doesn't limit your legal rights if the Video doesn't match the contract (section 12).

10. Rights to the Video

We keep the copyright in the Videos we make. When the order is paid, we give you a non-exclusive, worldwide licence without time limit to use your Video in these ways:

1. publishing it online and making it available to the public, including on YouTube, YouTube Shorts, TikTok, Instagram, Facebook, X, Twitch, Discord, your website and Roblox or Minecraft community platforms;
2. earning money from those publications (ads, sponsorships, creator funds, channel memberships);
3. making digital copies of it;
4. editing it: cutting, cropping, adding subtitles, music, voice or your logo, and combining it with other material;
5. using it to promote your channel, game, server or brand, including in ads.

We will not sell or license your Video to anyone else. We may show it in our portfolio and on our social media after you publish it, or 30 days after delivery, unless you ask us not to (in your order notes or by email).

Roblox and Minecraft are trademarks of Roblox Corporation and Mojang Studios (Microsoft). We are not affiliated with or endorsed by them. Their characters and worlds remain theirs, and you are responsible for following the Minecraft Usage Guidelines and the Roblox Terms of Use when you publish your Video.

11. Cancelling and your right of withdrawal

If you are a consumer, you have 14 days from the contract to withdraw from it without giving a reason.

Because we make each Video to order, at checkout you ask us to start work straight away and confirm you understand that:

• if you withdraw after work has started, you pay for the work already done;
• you lose the right of withdrawal once the final Video has been delivered.

12. If something is wrong (complaints)

We must deliver a Video that matches your order. If it doesn't, you have the rights given by law: we fix it free of charge, and if we can't or won't, you can ask for a lower price or end the contract and get your money back. For consumers, we are responsible for problems that exist at delivery and show up within 2 years.

To complain, email fellystar@outlook.com with your order code and what is wrong. We reply within 14 days. The same applies to complaints about the Website or your account.

If you are a consumer and we can't agree, you can ask for free help from a municipal or district consumer ombudsman (rzecznik konsumentów) or the Provincial Inspectorate of Trade Inspection (WIIH). If you live in another EU country, the European Consumer Centre in your country can help.

13. Liability

We are not responsible for decisions of platforms such as YouTube or TikTok (for example demonetisation or removal) that are not caused by our work, or for problems caused by Your Materials.

For business customers, our total liability for an order is limited to the price paid for it.

Nothing in these terms limits our liability where the law does not allow it, including for damage caused on purpose or through gross negligence, or your rights as a consumer.

15. Changes to these terms

We may change these terms for important reasons, such as changes in the law, our services or prices. We show the new version here with its date, and tell account holders by email at least 14 days before it applies to their account. Orders already placed always follow the version accepted when ordering.

16. Law and courts

These terms are governed by Polish law. If you are a consumer living in another country, you keep the protection of the mandatory laws of that country. Disputes go to the courts that have jurisdiction under the general rules of law.
